Happy Hair Solutions Inc., hereinafter "We", "Us," "Our", “Company”, develops HairCare mobile application (“Our Product”, “Our Application”, “The App”). Our Application can be downloaded from the App Store, which is operated and owned by Apple Inc. and other companies within its group ("Apple"). HairCare mobile application offers content, features, functionality, and other information and services, hereinafter “Our Services”. Our mission is to help people to maintain healthy hair and establish an effective hair care routine. We create Our Product for informational purposes only. All Our Services have a recommendation character.
You must ALWAYS consult your physician, doctor or hair care specialist before starting any program. Subscribers, account holders, customers, users, and others who download, access, use, purchase and/or subscribe to the Services (“you”) agree to these Terms and Conditions (the “Terms and Conditions”). By agreeing to these Terms and Conditions, you confirm that you are solely responsible for the state and health of your hair. These Terms and Conditions govern your use of the Services and are a condition to your use of the Services.
2. Acceptance of Terms and Conditions.
By using Our Product and Services, you accept these Terms and Conditions. If you do not accept these Terms and Conditions, you may not use Our Product and Services. Happy Hair Solutions Inc. has the right to amend these Terms and Conditions at any time without prior notice. An up-to-date version of these Terms and Conditions will be available on the official website of Happy Hair Solutions Inc., and all the changes will come into effect immediately after posting. By continuing to use HairCare app, you agree to the amendments made to Terms and Conditions.
3. Medical and Beauty Services Disclaimer
The Company is not a licensed medical care provider and the app is not intended to replace professional medical advice or diagnose and treat hair disorders. Please consult with a licensed physician or other qualified healthcare provider before using any Service provided by the Company.
Happy Hair Solutions Inc. is not a licensed beauty services provider. We do collaborate with some licensed beauty and hair care specialists, but all our services have a recommendation character ONLY.
WE DISCLAIM LIABILITY FOR ANY HEALTH ISSUES
WE DISCLAIM ANY RESPONSIBILITY FOR HEALTH AND STATE OF YOUR HAIR ISSUES.
THE COMPANY DOES NOT ASSUME ANY LIABILITY FOR INACCURACIES OR MISSTATEMENTS ABOUT ANALYSIS REPORTS, HAIR CARE RECOMMENDATIONS AND ANY OTHER SERVICES AND INFORMATION PROVIDED IN THE APP.
WE MAKE NO GUARANTEES CONCERNING THE LEVEL OF SUCCESS YOU MAY ACHIEVE IN YOUR HAIR CARE. YOU ACCEPT THE RISK THAT RESULTS WILL DIFFER FOR EACH INDIVIDUAL. THE EXAMPLES AND THE SERVICE PROVIDED ARE BASED INDIVIDUAL RESULTS AND EMPIRICAL APPROACH, WHICH MAY NOT APPLY TO AN AVERAGE PERSON, AND ARE NOT INTENDED TO REPRESENT OR GUARANTEE THAT ANYONE WILL ACHIEVE THE SAME OR SIMILAR RESULTS. WE CANNOT GUARANTEE YOUR FUTURE RESULTS AND/OR SUCCESS. NOR CAN WE GUARANTEE THAT YOU MAINTAIN THE RESULTS YOU ACHIEVED IF YOU DO NOT CONTINUE USING OUR SERVICES.
WE DISCLAIM ANY RESPONSIBILITY FOR ERRORS OR OMISSIONS, OR FOR UNINTENDED TECHNICAL INACCURACIES, OR TYPOGRAPHICAL ERRORS IN THE PROVIDED MATERIALS, AS WELL AS VIOLATION OF ANY ETHICAL OR MORAL STANDARDS APPLICABLE IN YOUR COMMUNITY TO SEXUAL EDUCATION AND RELATED MATERIALS.
4. Intellectual Property.
All Product and Services texts, designs, logos, button icons, images, data compilations, and information (hereinafter "Content") are the Intellectual Property of Happy Hair Solutions Inc. and are protected by copyright laws. All logos and trademarks displayed in Our Product and Services are trademarks of Happy Hair Solutions Inc. No texts, designs, logos, button icons, images, data compilations, Content and trademarks can be used
without the prior written consent of Happy Hair Solutions Inc.
To use HairCare App, you may be required to create or update an account (“Account”) and will be asked to provide certain personal information.The personal information asked includes a series of questions related to the state and health of your hair, your hair type and hair care habits.
To be eligible to create an Account, access the App and use it, you must meet the following requirements:
be at least 13 years old (16 years old in EU)
not be barred from using the App under applicable law.
The users under 18 years old must review and accept the terms of this Agreement with their parent or guardian. By using the App, you confirm that your parent or guardian has reviewed and accepted this Agreement.
6. User Content
Any content you upload or create in the App will be considered non-confidential and non-proprietary. The User grants Hair Care Inc. the irrevocable, free, non-exclusive, and unlimited right to use all content generated, transmitted, saved and published by such User. Considering the automatic assessment of the User content created, the User may receive certain offers and/or marketing messages tailored to such User.
7. Conditions of App Usage
In return for your agreeing to to follow these Terms you may:
download the App onto a device and view, use and display our App on the device for your personal purposes only;
use any related documentation to support use of our App as permitted by these Terms; and
receive updates to the software code of our App via our Apps store that you downloaded our App from – these may incorporate patches and corrections of errors as we may provide to you.
Your right to use our Apps is personal to you. You are restricted from sharing our Services and transferring the App to anyone else for any reason. In case of selling or giving away the device which the App operates on, you must delete our App from it first.
The ways in which you can use our Apps may also be governed the terms of the App Store that you downloaded our Apps from. If there is a conflict between these Terms and the terms of the App Store that you downloaded our App from, the terms of our Apps Store which you downloaded our Apps from will take the priority.
8. Restrictions on Use
Unless you have requested and received our prior written consent, you must not:
copy our App except as part of the normal use of our App or where it is necessary for creating a back-up or operational security;
modify or translate our Apps in whole or in part, combine or merge our Apps with any other code or program;
reverse engineer, decompile, disassemble, reduce the object code of our App to source code form or create (or attempt to create) derivative works based on the whole or any part of our Apps, except to the extent permitted by applicable law
use any copyright, trademark, or other proprietary notices, Content or Services belonging to us, our licensors or other third parties contained within our App;
incorporate our App into another service or website;
extract any data or metadata from our App;
do any damage to our App;
perform any harmful or illegal activities using our App;
use our App in any manner not expressly authorized by these Terms.
9. Use at Your Own Risk
Our mission is to encourage the users to maintain healthy hair and establish an effective hair care regime.
However, the App cannot and does not guarantee health-related and beauty improvements or outcomes. Your use of the App and any information, predictions, or suggestions provided in the App are at your risk. We do not make a warranty of any kind as to the accuracy of data, information and predictions that we may supply you with through the App Therefore, you agree and understand that the App is not intended to match or serve the same purpose as a medical or scientific device.
10. Warranty disclaimer
The Company controls and operates the App from different locations and does not guarantee that the App is appropriate or available for use in all the locations. The App or certain features of it may not be available in your region or/and may vary across the locations.
The App is provided “as is”, “as available”. We do not provide any representations or warranties of any kind, expressed or implied.
The Company does not make any warranty that the Services will meet your requirements. We do not guarantee that the access to the Product and Services will be uninterrupted, timely, secure, or error-free, or that defects, if any, will be corrected. The Company makes no warranties as to the results that may be obtained from the use of the Services or as to the accuracy, quality, or reliability of any information obtained through the Services. The Company disclaims any warranties for other Services or goods received through or advertised on the Services, or accessed through any links on the Services. The Company disclaims any warranties for viruses or other harmful components in connection with either the Product or Services.
HairCare App Premium subscription. The mobile application offers the Premium subscription that grants you access to additional features like individual DIY recipes, personalized hair care plan, detailed information about your hair, recommendations about hair care products. Some of our subscriptions include a free trial period, where you can experience the mobile application at no cost. Subscription with the free trial period will automatically renew to a paid subscription once your free trial expires. If you decide to unsubscribe from a paid subscription before we start charging your payment method, cancel the subscription before the free trial ends.
We offer monthly, 3 months, 6 months and annual subscription options. Payment will be charged to your credit/debit card through your Apple ID after you choose one of our subscriptions and confirm your purchase. Paid subscriptions automatically renew unless auto-renew is turned off until cancelled. We will notify you if the price of subscription increases and, if required, seek your consent to continue. You will be charged no more than 24 hours prior to the start of the latest paid subscription period.
12. Limitation of liability
In no event shall the Company be responsible for any damages resulting directly or indirectly from any aspect of your use of the Product, Website, Content, or Services. You must evaluate, and agree to bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of the services. You specifically acknowledge that the Company is not liable for the defamatory, offensive, or illegal conduct of Users or third parties.
Under no circumstances shall the Company be liable for indirect, special, punitive damages including to loss of use, profits or loss of data caused or in any way related to the use of the App.
The Company or any third party referred to in the App are not liable for any personal injury, including death, caused by use or misuse of the Product or Services.
13. Your Feedback
Your feedback is important for us. By using the app, you agree that any communications you send to us or publish in App Stores may be submitted on a non-confidential basis. You agree that we may decide to publicize such contents at our own discretion. You agree to authorize us to make use of such contents for free, and revise, modify, adjust and change contextually, or make any other changes as we deem appropriate.
